Terms & Conditions

ODM Platforms is operated by BapuTalk Media Platforms, registered at VPO Sirsala, District Churu, Rajasthan, India. These Terms & Conditions (“Terms”) govern your access to and use of odmplatforms.com and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

1) Nature of Services (Intermediary)

• The Platform is a job-listing and networking intermediary exclusively for dental sector opportunities (e.g., Dentist, Endodontist, Prosthodontist, Orthodontist, Periodontist, Pedodontist, Oral Surgeon, Dental Assistant/Hygienist, Dental Technician/Lab Staff, Front Desk/Reception for dental clinics).
• We do not conduct recruitment, placement, or background verification. We do not guarantee interviews, offers, or employment outcomes.
• Content (job posts, profiles, ads) is supplied by third parties. The Platform is not responsible for its accuracy, completeness, or legality.

2) Eligibility

• You must be capable of forming a legally binding contract under Indian law. If you are under 18, you must use the Platform through a parent/guardian.
• Employers/Recruiters must be duly authorized to post jobs and hire.

3) Account & Access

• You are responsible for your account, device, and login confidentiality, and for all activities under your account.
• Provide accurate, current, and complete information; promptly update any changes.
• We may suspend or terminate access for suspected fraud, misuse, or breach of these Terms.

4) User Responsibilities

• Employers/Recruiters: Ensure postings are accurate and lawful; comply with applicable Indian laws (including labour/wage, professional council norms, anti-discrimination, and advertising standards).
• Job Seekers: Independently verify employer identity, credentials, compensation, and role details before proceeding.
• Do not upload illegal, defamatory, infringing, harmful, misleading, or discriminatory content.

5) Prohibited Conduct

• Spam, scraping, data harvesting, or automated access without written permission.
• Posting fake jobs/profiles, fee-for-job scams, or phishing.
• Reverse engineering, interfering with Platform security, or attempting unauthorized access.

6) Content & Intellectual Property

• Except user-submitted content, all Platform content, trademarks, and logos are owned by BapuTalk Media Platforms or its licensors.
• Users grant the Platform a non-exclusive, worldwide, royalty-free license to host, display, and distribute submitted content for Platform purposes.
• Do not copy, distribute, or exploit Platform content without prior written consent.

7) Payments, Plans & Refunds

• Paid services (if any) are billed as described at purchase. Prices and features may change.
• Except where required by Indian consumer laws, all fees are non-refundable.
• Payments are processed by third-party gateways; we do not store sensitive payment data.

8) Third-Party Links & Services

• Links to third-party sites/services are provided for convenience only. We do not endorse or control them and are not responsible for their content or practices.

9) No Employer–Employee or Agency Relationship

• Using the Platform does not create any employment, agency, partnership, or joint venture with ODM Platforms.
• We are not a party to any contract between Employers and Job Seekers.

10) Verification & Due Diligence

• Employers are solely responsible for verifying candidate qualifications, registrations, and licenses.
• Job Seekers are solely responsible for verifying job details, work conditions, salary, and employer legitimacy.

11) Privacy

• Your use of the Platform is also governed by our Privacy Policy (to be provided separately). By using the Platform, you consent to our data practices as described therein.

12) Disclaimers

• The Platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
• We do not warrant uninterrupted, timely, secure, or error-free operation.
• We do not warrant the accuracy or reliability of third-party content, postings, or communications.

13) Limitation of Liability

• To the maximum extent permitted by Indian law, BapuTalk Media Platforms, its directors, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Platform.
• Without limiting the foregoing, we shall have no liability for loss of data, loss of opportunity, income, or reputation; misrepresentation by users; harassment or misconduct by users; outages, cyber incidents, or events beyond our reasonable control.

14) Indemnity

• You agree to indemnify and hold harmless BapuTalk Media Platforms and its affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your content, your use or misuse of the Platform, or your breach of these Terms or applicable laws.

15) Suspension & Termination

• We may suspend or terminate access at any time for suspected fraud, illegal activity, or breach of these Terms.
• Upon termination, your right to use the Platform ceases immediately; provisions intended to survive (e.g., intellectual property, disclaimers, limitation of liability, indemnity, governing law) shall continue.

16) Changes to the Platform and Terms

• We may modify or discontinue any feature at any time.
• We may update these Terms from time to time. Continued use after changes constitutes acceptance of the revised Terms.

17) Compliance with Indian Law

• These Terms are governed by the laws of India, including the Information Technology Act, 2000 and applicable rules, and relevant employment and professional regulations.

18) Dispute Resolution and Jurisdiction

• Parties shall first attempt amicable resolution via written notice and a 30-day negotiation period.
• Subject to the foregoing, disputes are subject to the exclusive jurisdiction of courts at Churu, Rajasthan, India.

21) Electronic Communications & Records

• You consent to receive communications electronically and agree that all agreements, notices, and records we provide electronically satisfy legal requirements.

22) Severability, Waiver, Entire Agreement

• If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force.
• Our failure to enforce any provision shall not be a waiver of that provision.
• These Terms constitute the entire agreement between you and us regarding the Platform, superseding prior understandings.
